A lawyer from Donald Trump’s weaponized Department of Justice got her a** handed to her by a federal judge this week in a case that could impact the scope of presidential power.
Trump has been using the DOJ as a retaliatory tool to seek revenge against his enemies. In particular, he has targeted former FBI Director James Comey twice. The courts dismissed the case against Comey because the prosecutor was unlawfully appointed. The DOJ then filed a second case against Comey over his “8647” post that Trump claims is a veiled call for his assassination, even though the meaning of the term “86” is broad.
In short, it’s a witch hunt against Comey to punish him for investigating Trump’s ties with Russia. Trump’s obsession with punishing Comey also extended to his family members, as he had Comey’s daughter, Maurene Comey, fired from her position as a federal prosecutor in Manhattan.
Trump’s DOJ fired Maurene Comey via a letter citing only the Article II powers of the president in the Constitution. She and her attorney filed a lawsuit alleging that her firing occurred “solely or substantially because her father is former FBI Director James B. Comey, or because of her perceived political affiliation and beliefs, or both.”
Indeed, Maurene Comey also worked on the criminal cases against Jeffrey Epstein, Ghislaine Maxwell, and their child sex trafficking ring, of which Trump is closely tied to, seeing as how his name appears in the Epstein files over 38,000 times, more than any other name.
Anyway, during a hearing in Comey’s lawsuit, Trump DOJ lawyer Karen Lesperance pathetically defended the firing by claiming that it was valid even if politically motivated. The judge didn’t buy it.
According to Politico:
U.S. District Judge Jesse Furman pressed Lesperance on whether there are any limits to the president’s Article II powers. Could the president, for example, decide to fire people in order to achieve an “all-white executive branch? Or all-black?” he asked.
Lesperance stammered in response, finally saying, “I can’t answer on behalf of the government.” Furman replied: “You’re here representing the government.”
You can’t represent the government and not know the position of the government. Trump’s DOJ is full of hacks who should never have been allowed to work there in the first place. This is an embarrassing moment for Trump and his DOJ. And the judge makes a great point that every racist Trump supporter should consider.
If the president can engineer an all-white executive branch, nothing stops the next president from firing all of them in favor of an all-black executive branch. Maybe that’s what we need to finally chase the racists back into the holes they crawled out of in 2016.
